Terms of Service

1. Acceptance of Terms

By accessing or using SiteHealth ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you (or the organization you represent) and SiteHealth. If you are accepting these Terms on behalf of an organization, you represent that you have the authority to do so.

2. Service Description

SiteHealth is a website health monitoring platform that performs automated checks on WordPress websites, including but not limited to uptime monitoring, security scanning, SEO analysis, performance measurement, and compliance checks.

The Service is provided on a subscription basis. Features available to you depend on your subscription plan (Starter, Pro, or Agency). We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

SiteHealth is not a security guarantee. Scan results are informational and reflect the state of your site at the time of the scan. We do not warrant that scans will detect all vulnerabilities or issues.

3. Account Registration

To use SiteHealth, you must create an account by providing a valid email address and creating a password. You are responsible for:

You may not share your account with others or create accounts on behalf of others without their knowledge. Each account is for the use of a single individual or organization.

4. Billing & Refunds

SiteHealth offers monthly and annual subscription plans. All payments are processed securely by Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

Free trial: New accounts receive a 14-day free trial with full access to your selected plan. No credit card is required to start a trial. At the end of the trial period, you will be asked to enter payment details to continue using the Service.

Money-back guarantee: If you are unsatisfied with the Service within the first 14 days of a paid subscription, contact us at hello@sitehealth.app for a full refund. No questions asked.

Cancellations: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for partial billing periods, except as required by applicable law.

Price changes: We may change subscription prices with at least 30 days' notice. Price changes will not apply until your next renewal date.

5. Prohibited Uses

You agree not to use SiteHealth to:

6. Intellectual Property

The SiteHealth platform, including its software, design, logos, and content, is owned by SiteHealth and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written permission.

You retain full ownership of your data, including the website URLs and scan results associated with your account. By using the Service, you grant us a limited, non-exclusive license to process your data solely to provide and improve the Service.

The WordPress companion plugin is made available under an open-source license (see the plugin repository for details). This does not grant rights to the broader SiteHealth platform.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free from harmful components. We do not guarantee that scan results will be accurate, complete, or timely.

8. Limitation of Liability

To the maximum extent permitted by applicable law, SiteHealth and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising from or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) $100 USD.

9. Termination

You may terminate your account at any time by canceling your subscription and deleting your account from the dashboard settings.

We may suspend or terminate your access to the Service immediately and without notice if we determine that you have violated these Terms, your payment has failed, or continued access poses a risk to other users or the platform.

Upon termination, your right to access the Service ends immediately. We will delete your data in accordance with our Privacy Policy.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by displaying a notice in the dashboard at least 14 days before the changes take effect.

Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the new Terms, you must stop using the Service before the effective date.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [State/Country], without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the courts located in [State/Country].
